If you use the Juniors Coach Club website or any of its affiliated social media platforms, you are bound by the Terms and Conditions. These platforms are registered under the company name “Juniors Coach Club Marketing Operation and Management LLC,” and include the website Juniorscoachclub.com.
The Juniors Coach Club is the entity responsible for producing these platforms. Throughout these User Terms, the words “we,” “us,” and “ours” refer to Juniors Coach Club. The Juniors Coach Club Marketing Operation Management LLC is registered under a trade license from the Abu Dhabi Development of Economic Department.

These User Terms encompass all other regulations, procedures, policies, and guidelines that govern your use of the Website and that are referenced in this document or may be published on the Website in the future (these regulations, policies, and guidelines may be modified from time to time), including but not limited to:

In the event that there is a contradiction between the terms outlined in these User Terms and the User Guidelines, the User Guidelines will take precedence.
By using the Website or any other social media platforms linked to Juniors Coach Club, you agree to be bound by these User Terms and Conditions, which includes the User Guidelines. If you do not agree to these User Terms, you are not authorized to use the Website or any linked social media platforms and are requested to discontinue using them immediately. Please note that registering as a user on the Website constitutes your express acceptance of these User Terms.

1. User Registration- Registered User

The website offers user registration services for those who want to become a Registered User. By creating a profile and registering as a user, you will be granted a non-exclusive, non-transferable, revocable, limited right to access and use the Website. Please note that only one profile per person is permitted and the profile is personal, meaning it cannot be transferred to others.
To become a Registered User, you need to select a password that must be used with your email address when logging onto the Website. The website may require additional profile verifications, such as facial recognition or third-party software, to increase safety measures for users. Alternatively, we can send the password to you.
Remember that the password is personal and must not be transferred or made available to others. It is your responsibility to ensure that the password does not fall into the hands of a third party. If you become aware that the password is or may have been compromised, you must inform us immediately. We reserve the right to change the password if there is a risk that it has been compromised or is used in violation of the User Terms.
When you sign up for our website, you must choose a username that will appear whenever you write comments, reviews, or other user-generated content. It is important to consider whether you want to use a username that others can easily identify you by. Your username cannot be offensive, contain certain terms or characteristics, or infringe on any third party rights. You are responsible for ensuring that your username meets these requirements.

We reserve the right to delete, suspend, or modify your profile at any time without notice if you violate our User Terms or applicable laws. If your profile is deleted, you will lose access to services that require registration or login. Any user-generated content you created on the website may also be deleted.
When you register, you must choose a username which will be visible to others when you write reviews or produce user-generated content on the website. Your username should not be offensive, insulting, or infringe on the rights of third parties, including intellectual property rights.
We reserve the right to delete or change your profile, including your username, without notice or explanation if we suspect a violation of the user terms or applicable law. If you wish to change your username, you must contact us. If we delete your profile, you will lose access to services requiring registration and your user-generated content may also be deleted.
Finally, if you attempt to gain access to registered user parts of the website without being registered, we will consider it a violation of the user terms and our disclaimer applies

2. User-Generated Content from Registered Users

As a Registered User, you grant us the right to use and exploit any User-Generated Content (UGC) you create on the Website, including publishing, displaying, reproducing, modifying, and creating derivative works.
We can also freely disclose the UGC to third parties. You are responsible for the UGC you post on the Website, and you warrant that it is accurate and true or genuinely held opinions. The UGC must be related to a company, organization, or individual coach from whom you have used services or can provide documentation of using their products or services.
You cannot publish UGC about a company, organization, or individual coach with whom you have a personal relationship. This also means that you cannot be incentivized financially or otherwise to post UGC that benefits a particular company, organization, or individual coach on the Juniors Coach Club Website or other social media platforms.
Registered Users are prohibited from publishing any User-Generated Content on the website which is of a marketing nature or has marketing purposes. Additionally, the published content must not be unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, tortious, obscene, pornographic or profane, and must not have sexist, political, or racial character.
The content must not violate any intellectual property rights, rights of privacy, and/or rights of publicity of other individuals. Furthermore, the content must not be offensive or in any way breach any applicable local, national, or international law or regulation. Users are also prohibited from revealing personal information about another individual, such as their name, address, phone number, email address, credit card information, or any other information that could be used to track, contact or impersonate that person.
The published content must not have a disloyal or unlawful purpose or content, and must not promote unlawful purposes. It must not be technically harmful, including without limitation computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data, or other malicious software, harmful data, or conduct.
Additionally, any published content must not violate the media guiding policies and procedures of the UAE. Lastly, if Registered Users present professional certifications to promote their services, they must ensure that these certifications are updated and genuine, and Juniors Coach Club will not be liable if these certifications are found to be not genuine, expired, or not accepted by the regular authority responsible for such regulations in the UAE.
It is important to note that as a Registered User, you are responsible for ensuring that any User-Generated Content you publish on the Website is lawful, truthful, and in compliance with the User Terms and applicable legislation.
If Juniors Coach Club becomes aware of any UGC that violates current legislation or the User Terms, we reserve the right to delete the content without notice and may even inform the violated party or authorities, depending on the nature of the violation.
As a contributor of UGC, you grant Juniors Coach Club the right to take any legal actions deemed necessary in case of any infringement of your UGC. You are also responsible for indemnifying Juniors Coach Club against any claims made against us as a result of your violation of the User Terms or applicable legislation.
Finally, please note that Juniors Coach Club may request information from you regarding your UGC, including documentation supporting the information included in the content. This documentation could include evidence that your UGC is based on an actual buying experience or customer relation with the company, organization, or individual coach to which the UGC relates.

GENERAL TERMS

3. Rights

This section of the User Terms outlines the ownership of the Website and its services, as well as the intellectual property rights associated with it. It specifies that the Website, its underlying technology, and the content on the Website are the sole and exclusive property of Juniors Coach Club or third parties, and that no license or right is granted to any such underlying technology.

If a Registered User provides Feedback regarding the Website or services offered on the Website, Juniors Coach Club is free to fully exploit such Feedback. The content on the Website is protected by UAE and applicable international legislation, including without limitation applicable copyright and trademark laws. Any unauthorized copying, distribution, presentation or other use of the Website or part thereof is a violation of UAE law and may result in civil and/or criminal penalties.
The User Terms also state that the rights to free use of the UGC are transferred to Juniors Coach Club irrevocably, without any time or territorial limitations, by submitting the UGC to the Website. Downloading and other digital copying of the content on the Website or parts thereof are only permitted for personal non-commercial use unless otherwise agreed with Juniors Coach Club in writing or allowed under applicable mandatory law.
Finally, it is specified that all company names, trademarks, and other business characteristics on the Website are the property of Juniors Coach Club or third parties, and may only be used for business purposes upon prior approval from Juniors Coach Club or the third-party owner, respectively.

5. Disclaimers

The Website, its Content, and the services provided on it are given on an “as is” and “as available” basis, and there are no representations or warranties of any kind. Juniors Coach Club explicitly disclaims any and all warranties, whether express, implied or statutory, including but not limited to warranties of non-infringement, merchantability or fitness for a particular purpose. The Website and its services may be updated, modified, interrupted, suspended or terminated at any time without liability or notice.

We do not provide any warranties or guarantees regarding the User-Generated Content (UGC) that is published on the Website. However, we reserve the right to investigate and modify UGC if it is necessary for compliance with our User Guidelines, requested by third parties, or required by law.
We are not responsible for the content of the UGC, including any links to third-party websites. Any recommendations or reviews made by Registered Users regarding specific services or businesses are not endorsements by us, and we are not liable for the content on the Website or the availability of our services. It is the sole responsibility of the Registered Users to use our services responsibly.

6. Limitation of liability

WE SHALL NOT BE HELD RESPONSIBLE FOR ANY DAMAGES ARISING FROM THE USE OF THE WEBSITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY. EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, CONTRACTS, TURNOVER, BUSINESS, BUSINESS OPPORTUNITY, LOSS OR CORRUPTION OF DATA OR RECOVERY OF DATA, GOODWILL, SECURITY BREACH RESULTING FROM A FAILURE OF THIRD PARTY TELECOMMUNICATIONS AND/OR THE INTERNET, ANTICIPATED SAVINGS OR REVENUE, OR ANY OTHER INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE, REGARDLESS OF WHETHER ANY OF THESE ARE DIRECT OR INDIRECT. WE ALSO CANNOT BE HELD LIABLE FOR ANY LOSS OR DAMAGE ARISING IN CONNECTION WITH LIABILITIES TO THIRD PARTIES. IT IS IMPORTANT TO NOTE THAT SOME REGIONS AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Our liability for any and all claims arising from or related to the User Terms, the Website, or our services, including but not limited to breach of contract, misrepresentation (whether tortious or statutory), tort (including negligence), breach of statutory duty, or otherwise, is limited to a total aggregate liability of 500 dirhams only.
You also agree that any claims or actions related to the use of our Website or services or these User Terms must be brought within one (1) year of the actionable event. Please note that nothing in these User Terms excludes or limits either party’s liability for matters that cannot be excluded or limited under applicable law.

7. Other User Terms

We reserve the right to modify or update these User Terms at any time in our sole discretion. We will make a reasonable effort to give notice of any changes. We may also, at any time and without notice, close, alter or reorganize the Website.
As a Registered User, you agree to abide by the most current User Terms at all times. Any changes to the User Terms will be posted on the Website, and we will endeavor to inform Registered Users of the changes.
By continuing to use the Website after a modified version of the User Terms is posted, Registered Users accept the modified User Terms. If any part of these User Terms is deemed unlawful or unenforceable, it will not affect the validity or enforceability of the remaining provisions.
The term of the User Terms will continue until it is terminated by either party. We may terminate your access and use of the services offered on the Website at any time and for any reason without incurring any liability.
If we terminate your access or if you choose to delete your profile, all rights granted to you under the User Terms will immediately end. However, sections 2-10 will continue to be applicable even after the termination of the User Terms.

8. Applicable law and venue

The User Terms and the relationship between you and Juniors Coach Club are subject to the laws of the UAE, regardless of the conflict of law provisions. Any disputes must be exclusively resolved in the UAE Justice Department, and both parties agree to the jurisdiction of such courts.

9. Copyright dispute policy

Juniors Coach Club has a policy in place to prevent copyright infringement on its platform. If the company believes, in good faith, that any of its advertisers, affiliates, content providers, members or users have copied and distributed copyrighted material illegally, it will block access to or remove such material.
Additionally, the company will discontinue service to repeat offenders. Juniors Coach Club has adopted a policy regarding copyright infringement that complies with the Digital Millennium Copyright Act or DMCA.

10. Miscellaneous

These are standard provisions in a contract that clarify that the User Terms constitute the entire agreement between the parties and supersede any prior agreements or communications.
They also clarify that the agreement does not create an agency or partnership relationship between the parties and that any failure to require performance or waiver of a breach does not affect the right to enforce the provision in the future. Finally, they state that the user may not assign any rights granted to them under the agreement.
